THE HON'BLE SRI JUSTI CE SANJAY KUMAR WRI T PETI TI ON No.3356 of 2019 ORDER:

The prayer of the petitioner in this case reads as under: 'For the reasons stated in the accompanying affidavit, the petitioner humbly prays that this Hon'ble Court may be pleased to issue appropriate writ or order or orders and more particularly in the nature of Writ of Mandamus declaring that the acts, deeds and things of the 5th respondent in not conducting any enquiry and not mutating the name of the petitioner in the revenue records as pattadar even though required applications have been submitted long back and also on 30-01-2019 for issuance of pattadar passbook and title-deed by mutating the name of the petitioner in the revenue records for the land admeasuring 2 acres in Sy. No.63/121/A and 63/121/A/1 situated at K.P.

Jagannadha Puram, Palvoncha Mandal, Bhadradri Kothagudem District as successor of her late husband Konka Anantharamulu in accordance with the RoR Act are illegal, mala fide, arbitrary, violative of principles of natural justice and much against to the legal and fundamental rights guaranteed under the Constitution of India and consequently direct the 5th respondent to conduct enquiry and to issue pattadar passbook and title-deed by mutating the name of the petitioner in the revenue records for the land admeasuring 2 acres in Sy.No.63/121/A and 63/121/A/1 situated at K.P.

Jagannadha Puram, Palvoncha Mandal, Bhadradri Kothagudem District as successor of her late husband Konka Anantharamulu in accordance with The Telangana Rights In Land and Pattadar Pass Books Act, 1971, and to pass such other order or orders as deem fit and proper in the circumstances of the case and in the interest of justice, equity and good conscience, as otherwise, the petitioner shall be put to grave and inexplicable hardship and injury.'

Perusal of the record reflects that the petitioner submitted an application in the prescribed format in Form VI (A) under the Telangana Rights in Land and Pattadar Pass Books Act, 1971, in relation to the land inherited by her from her husband, late Anantharamulu. It is not open to the revenue authorities to remain somnolent after receiving an application in the prescribed format. The writ petition is accordingly disposed of directing the Tahsildar, Palvoncha Mandal, Bhadradri-Kothagudem District, to take appropriate action on the petitioner's application dated 25.01.2019 expeditiously and in any event, not later than four weeks from the date of receipt of a copy of this order.

Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs. ____________________ JUSTI CE SANJAY KUMAR Date:20.02.2019 Note:
