This Criminal Petition, under Section 482 of Code of Criminal Procedure, 1973 (for short 'Cr.P.C.'), is filed seeking a direction to V Additional District and Sessions Judge, Kurnool at Nandyal, to fix schedule for trial in S.C.No.427 of 2015 as early as possible on the ground that the matter was adjourned so many times during last year for fixing schedule.

2. It appears from the allegations made in para No.3 of the Petition, the matter was adjourned so many times to fix a schedule and no schedule is fixed though the matter relates to the year 2015 and adjourning the matter without giving any reason, it is nothing but violation of the fundamental rights guaranteed under Article 20 of the Constitution of India since speedy justice is the fundamental right to every citizen under the constitution.

3. In view of the above, this Criminal Petition is allowed and the V Additional District and Sessions Judge, Kurnool at Nandyal, is requested to fix schedule in S.C.No.427 of 2015 as early as possible and decide the matter, expeditiously, not later than six months in any event, from the date of receipt of a copy of this Order. Miscellaneous petitions, if any, pending in this Criminal Petition, shall stand dismissed.
