THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.2833 of 2018 ORDER:

This is the second round of litigation initiated by the petitioner who was a party to W.P.No.15239 of 2013. He along with three others earlier filed the said Writ Petition for the same relief challenging the interference of the respondents and this Court disposed of the said Writ Petition on 29.05.2013 with the following observations:

"It is not in dispute before this Court that the land in question is a Government land. The petitioners' claim is that they are the encroachers and they raised construction of the houses and they have been in possession and enjoyment of the said land for the last 10 years. The Gram Panchayat issued demand notices for payment of tax. Therefore, except by following procedure under law, the petitioners shall not be evicted.

Hence, the Writ Petition is disposed of directing the respondents to follow the law in evicting the petitioners from the land in question. There shall be no order as to costs." Now the petitioner states that there is a fresh threat of interference without following due process of law. In view of the earlier order of this Court, no further orders are required, except to state that the respondents have to follow due process of law, if they want any portion of the property held by the petitioner.

The Writ Petition is, accordingly, disposed of.
