HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY A.S.M.P. Nos.1727 & 1965 of 2015 AND APEAL SUIT No. 707 OF 2012 COMMON JUDGMENT:

Earlier on 30.07.2015, and, subsequently, on 08.09.2015, appellants 1 and 3 filed separate petitions seeking permission to withdraw the instant Appeal. But on 19.08.2015, this Court, only taking into consideration the petition filed by 1st appellant, ordered A.S.M.P. No.1727 of 2015 and dismissed the instant Appeal Suit as withdrawn. Subsequently, as non-ordering of the petition in A.S.M.P. No.1965 of 2015 is brought to my notice, the matter is being posted under the caption 'for being mentioned', recalled the earlier order passed on 19.08.2015 and passed the following modified order. In view of filing A.S.M.P. Nos.1727 and 1965 of 2015 by appellants 1 and 3, seeking permission to withdraw the Appeal Suit, both the petitions are ordered and, consequently, the Appeal Suit is dismissed as withdrawn.

In consequence, miscellaneous petitions, if any, pending in this Appeal, shall stand dismissed. No order as to costs. Registry to issue amended copy of the order.
