ORDER
This writ petition is filed seeking to declare the action of the 4th respondent in issuing notification dated 21.06.2016 inviting applications for appointment of dealer for fair price shop No.31, Poreddygaripalle, Kurabalakota Mandal, Chittoor District, on permanent basis, without bifurcation of original Shop No.16, Angallu, Kurabalakota Mandal, Chittoor District, as arbitrary and illegal. The petitioner was selected and appointed as fair price dealer on permanent basis in the year 1982 for shop No.16, Angallu, Kurabalakota Mandal, Chittoor District. His authorization was renewed from time to time and it is valid upto 31.3.2018.
The grievance of the petitioner is that while issuing the notification, the respondents have not followed the rule of reservation and they have not followed the uniform policy while bifurcating the existing fair price shops and that the impugned notification itself is without any basis. It appears that the notification was issued for fair price shop No.31, Poreddyvaripalli,Kurabalakota Mandal. The apprehension of the petitioner is that his authorization for fair price shop No.16 would be cancelled. Learned Government Pleader for Civil Supplies submits that as of now, there is no such proposal.
This writ petition, which was filed, on apprehension, cannot be maintainable and it is liable to be dismissed. Accordingly, the writ petition is dismissed. However, the petitioner is at liberty to approach the Court to take appropriate legal proceedings as and when cause of action arise.
In view of the disposal of the main writ petition, Miscellaneous Petitions, if any pending in this writ petition shall also stand closed.
