HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No. 11478 OF 2001 ORDER: (per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) Heard learned counsel for the petitioner. None appears for the respondents.

In this writ petition, the petitioner association sought to challenge the action of the respondents demanding payment of revised house tax from its members for the year 2000-2001 as arbitrary and illegal and further sought a direction to levy the pre-revised house tax on the members.

This Court while admitting the writ petition on 13.06.2001 issued ad interim direction. The ad interim direction in W.P.M.P.No.14225 of 2001 sought by the petitioner was not to demand payment of revised house tax for the year 2000-2001 from the members of the petitioner association. Keeping that in view and considering the passage of time we are satisfied that this writ petition can be conveniently disposed of by the following order:

"Respondents, for demanding revised tax from the members of the petitioner association or any other similarly placed persons, shall follow the due process of law. The concerned authority may also grant an opportunity of being heard to the representatives of the petitioner association, if necessary, before revision of house tax." With these observations, the writ petition is disposed of.

Miscellaneous petitions, if any, shall also stand disposed of. There shall be no order as to costs.
