O R D E R

By way of this writ petition, the petitioners sought a direction to the police

authorities, respondents 1 to 4 herein, not to interfere in their civil disputes with respondents 5 and 6 herein.

The Sub-Inspector of Police, Samalkot police station, East Godavari District, filed a counter-affidavit stating that on the complaint made by the wife of the sixth respondent herein, Crime No.229 of 2011 had been registered under Sections 384, 506 and 511 IPC on the file of the Samalkot police station. The petitioners herein are stated to be Accused Nos.1 and 2 in the said crime. Investigation was stated to have been undertaken in Crime No.229 of 2011 and the complainant and other witnesses were examined. The Sub-Inspector further stated that after completion of the investigation, a final report under Section 173 of the Code of Criminal Procedure would be filed before the competent Court. He asserted that on becoming aware of the registration of the crime, the petitioners filed this case only to divert attention. He denied the allegation of the petitioners that they were being called to the police station and were being pressurized to sign documents. No reply affidavit was filed by the petitioners rebutting the above counter-affidavit averments.

In the light of the aforestated facts, this Court cannot interdict the police authorities from carrying out their duties. Needless to state, in the course of investigation of the crime and taking appropriate steps against the petitioners herein, the police authorities are bound to follow the due procedure laid down by law. Making this position clear, the writ petition is dismissed. Pending miscellaneous petitions shall also stand dismissed. No order as to costs. ______________________ SANJAY KUMAR, J 08th JUNE, 2015 PGS
