THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.2810 OF 2018 ORDER:

Heard learned counsel for the petitioner and the learned Government Pleader for Home (T.G.) appearing for respondent Nos.1 to 4.

When the matter is taken up, written instructions, dated 31.01.2018, furnished by the Sub-Inspector of Police, Langer House Police Station, Hyderabad, are placed on record by the learned Government Pleader for Home. The said instructions read as under:

"One Sri Dr.Dakka Bhanu Prakash (5th respondent herein) has approached the Police of Langer House Police Station, Hyderabad and lodged a complaint on 29.1.2018 against the petitioner herein as he cheated by way of criminal breach of trust in the guise of settling the auction dispute with the Liquidator of Charminar Bank and usurping his hard earned money by way of misrepresentation and falsehood amounts to clear.

Upon receipt of the said petition, to know the veracity in the contents of the petition, an entry was made into the Station General Diary on 30.1.2018, after enquiry action will be taken on it.

I humbly submit that on coming to know the lodging of the above complaint, the petitioner with a malafide intention, to prevent the police from taking any action, filed the present writ petition with false and baseless allegations.

I humbly submit that preliminary enquiry is going on. Basing on the preliminary enquiry into the

petition, further course of action will be taken on the above complaint. As of now, this respondent police did not summon the petitioner nor interfered with the civil disputes as alleged.

I humbly submit that the petitioner is not at all required in any case registered on the file of Langer House Police Station. To prevent the police from taking any action, the petitioner on mere apprehension, filed the present writ petition." 3.

On noticing the same, a request is made by the learned counsel for the petitioner to place the said instructions on record and to dispose of the writ petition.

In view of the above, the Writ Petition stands disposed of, by placing on record the above said written instructions, dated 31.01.2018, furnished by the Sub-Inspector of Police, Langer House Police Station, Hyderabad. There shall be no order as to costs.

Consequently, Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
