THE HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY CRIMINAL PETITION Nos.15747, 15755 & 15762 OF 2016 COMMON ORDER:
These criminal petitions, under Section 482 of the Code of Criminal Procedure, 1973 (for short, 'Cr.P.C'), is filed seeking a direction to the XII Additional Chief Metropolitan Magistrate, City Criminal Courts, Nampally, Hyderabad, to dispose of Crl.M.P. Nos.5539 and 5509 of 2012, and 677 of 2013, in C.C. No.329 of 2009, as they are pending before the Court for the last four years.
These petitions are filed under Sections 91, 102 and 104 Cr.P.C. respectively to issue summons to the investigating officers, to produce the documents. But the learned Magistrate did not decide these petitions to proceed with the matter, and even the petition filed under Section 244 Cr.P.C. is also pending before the Court.
Proceeding against the matter without deciding the petitions referred above is nothing but unfair trial and hence the court has to decide the petitions referred above first. In view of pendency of Crl.M.P. Nos.5539 and 5509 of 2012, and 677 of 2013, in C.C. No.329 of 2009 since long time, I find that it is expedient to direct the learned Magistrate to decide these petitions, before proceeding further.

Miscellaneous petitions, if any, pending in these criminal petition, shall stand closed.
