HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.20813 of 2015 ORDER:

Heard.

The petitioner claims to be the owner of the land admeasuring Ac.6-20 gts. in Sy.No.303 situated at Alampur Village and Mandal, Mahaboobnagar District. The petitioner claims that the said property originally belonged to his father and after that, the petitioner and his three brothers have divided the property and the petitioner has been allotted the land aforesaid towards his share, which he is enjoying through out. He also stated that his name was also mutated in the revenue records and pattadar passbooks and title deeds were issued in his favour. However, his grievance is that recent ROR shows the extent of land as Ac.5-16 gts., instead of 6-20 gts., and therefore, he made an application to the 3rd respondent on 15-04-2013 to rectify the said defect, but no action is taken. Hence, the present writ petition is filed.

Learned Government Pleader has received instructions, which state that the total extent of Sy.No.303 is Ac.31-35 gts., and latest ROR shows that the land admeasuring Ac.5-16 gts., stands in the name of the petitioner. The petitioner, however, claims that he is the owner of the land admeasuring Ac.6-20 gts., and rectification of the revenue record to that extent is essential.

The instructions of the 3rd respondent, therefore, state that the petitioner should make an appropriate application under Form 6-A along with partition deed.

The petitioner, therefore, is at liberty to make an appropriate application under Form 6-A together with supporting evidence of partition among his brothers and enjoyment of the land claimed by him by approaching the 3rd respondent, who shall look into the grievance of the petitioner and pass appropriate orders expeditiously, preferably within four weeks from the date of receipt of a copy of this order.

Accordingly, the writ petition is disposed of. No costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
