HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL REVISION CASE No.174 OF 2015 ORDER:

The present Criminal Revision Case is filed under Sections 397 and 401 Cr.P.C., questioning the order dated 02.01.2015 passed in Crl.M.P. No. 2092 of 2014 by the Judicial First Class Magistrate, Pithapuram, wherein and whereunder the application filed for interim custody of the essential commodities seized by the Assistant Grain Purchasing Officer, Kakinada, was dismissed.

At the time when the matter is taken up for hearing, learned Additional Public Prosecutor submitted that the Authorities have already initiated Section 6-A proceedings and as such the present Revision cannot be entertained. The said fact is not disputed by the learned counsel appearing for the petitioner. Hence, the Revision is liable to be dismissed.

Accordingly, the Criminal Revision Case is dismissed leaving it open to the petitioner to approach the concerned Authority seeking release of the stock in which event the same shall be dealt with in accordance with law at the earliest.

Miscellaneous petitions, pending if any, in this Criminal Revision shall stand closed.
