THE HON'BLE SRI JUSTICE V. RAMASUBRAMANIAN THE HON'BLE SMT. JUSTICE T. RAJANI WRIT PETITION No.36086 of 2016 ORDER: (Per VRS,J) The petitioner, who secured admission to Kakatiya Medical College for the academic year 2015-2016, came up with the above writ petition, seeking a declaration that a person, who was lower in rank than her and who is arrayed as the 4th respondent, should not have been allotted a seat in Osmania Medical College, and that she was entitled to that seat.

By now, the academic years 2015-2016 and 2016-2017 are already over. The classes for the academic year 2017-2018 have also commenced.

Taking into account the above, the learned counsel for the petitioner submitted that at least a direction may be issued to the respondents to consider the representation of the petitioner. But, any representation for exchange of seat, cannot be unilaterally considered to the detriment of the 4th respondent. If there is a vacancy in Osmania Medical College, if the MCI regulations permit migration, if the petitioner is eligible for such migration, and if the period up to which migration can be permitted is available, the representation of the petitioner can be considered.

Therefore, the Writ Petition is disposed of, directing the University and the Director of Medical Education to consider the representation of the petitioner and pass appropriate orders, in accordance with law, after taking note of the above observations.
