HON'BLE SRI JUSTICE A. SHANKAR NARAYANA CRIMINAL PETITION No.5305 OF 2017 ORDER:

The present application, under Sections 437 and 439 of the Code of Criminal Procedure, 1973, is filed requesting to grant regular bail to accused Nos.10 and 13 in Crime No.4 of 2016 of Y.Ramavaram Police Station, Visakhapatnam District, registered as S.C.No.76 of 2016 on the file of the I-Additional Sessions Judge, Rajahmundry.

Initially, Sri Sravan Kumar Naidana, learned counsel for the petitioners, sought to grant regular bail to the petitioners, who are arraigned as accused Nos.10 and 13 in the aforesaid crime, on the ground that they have been in judicial remand since 31.01.2016 in connection with an offence punishable under Section 8 (c) read with 20 (b) (ii) of the Narcotic Drugs and Psychotropic Substances Act, but, subsequently, while fairly accepting that the bail petition filed by accused No.11, who stands on the same footing as that of the petitioners herein, was rejected by this Court on earlier occasion, requests this Court to direct the concerned court to dispose of the Sessions Case itself, inasmuch as 15 accused are involved in the present crime and they have been in judicial remand. Learned Additional Public Prosecutor would submit that accused No.15 was arrested on 29.03.2016 and, thus, all accused persons involved in the present crime have been in judicial remand.

CrlP_5305_2017 ASN,J Keeping in view, the submissions made by both sides, it is desirable to direct the I-Additional Sessions Judge, Rajahmundry, to dispose of Sessions Case No.76 of 2016 by fixing time frame. Accordingly, the Criminal Petition is dismissed rejecting the request for grant of regular bail. However, the learned I-Additional Sessions Judge, Rajahmundry, is directed to dispose of Sessions Case No.76 of 2016 as expeditiously as possible, but not later than eight months from the date of receipt of a copy of this order. ___________________________ A.
