HON'BLE DR. JUSTICE B. SIVA SANKARA RAO W.P. No.2789 of 2018 ORDER:
Heard both the counsel and perused the material on record. It is the contention of the learned counsel for the petitioner that the petitioner purchased the property way back in the year 1981 from the previous owners and since then she is in possession and enjoyment over the property and the contention of the respondents in claiming the property as if it is a Government land, is not correct.
Whereas it is the submission of the learned Government Pleader for Municipal Administration, Revenue and learned Standing Counsel for GHMC and HMDA that the subject land is the Government land and the petitioner is an unauthorized occupant and at best, she is entitled to super structure for its face value and not entitled to any right over the property. Having regard to the above and it is purely a civil dispute, the writ petition is disposed of directing the petitioner to approach the civil court to work out the remedies as early as possible and both parties shall maintain existing status-quo for one month. There shall be no order as to costs.
Consequently, miscellaneous petitions, if any pending in this writ petition shall stand closed.
