THE HON'BLE SRI JUSTICE T. AMARNATH GOUD WRIT PETITION No.3375 of 2020 ORDER :

The grievance of the petitioners is that the 7th respondentGrampanchayath is laying road from their private land. Heard both sides.

It is contended by Mr.G.Narender Reddy, Standing Counsel for the 7th respondent-Grampanchayat that already a 30 feet road is in existence. The petitioners, denying the said statement, submit that it is only for commutation of local villagers, a bullock cart way is there, but there is no 30 feet road, therefore, the question of respondents expanding it to 60 feet, without paying any compensation, does not arise. In view of the above contentions, this writ petition is disposed of directing the 2nd respondent-District Collector to look into the matter in its entirety, and in the event, if the respondents require the land of petitioners for the purpose of laying road, they shall consider their objections and after following due process of law, they shall take steps for acquiring the land of petitioners by paying compensation in accordance with law. No order as to costs.
