THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.37146 of 2015 ORDER:

The grievance of the petitioner was that the Moinabad Police Station authorities were not investigating Crime No.352 of 2015 pending on the file of the Moinabad Police Station, Ranga Reddy District, though it was registered as long back as on 02.10.2015.

Learned Assistant Government Pleader for Home placed before this Court a copy of the instructions dated 05.12.2015 furnished by the Sub-Inspector of Police, Moinabad Police Station, wherein it was stated that Crime No.352 of 2015 was registered under Section 3(1)(x) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 (for brevity 'the Act of 1989'), on the complaint made by the petitioner. Upon completion of investigation, a charge sheet was laid before the learned XXIII Metropolitan Magistrate, Cyberabad at Rajendranagar, on 24.11.2015. A copy of the said charge sheet is also placed on record and perusal thereof indicates that the police authorities opined that a prima facie case had been established against the accused constituting an offence punishable under Section 3(1)(x) of the Act of 1989.

In the light of the aforestated developments, the apprehension of the petitioner as to the alleged inaction on the part of the police authorities is shown to be without basis.

The writ petition is accordingly dismissed.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
