THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.11757 OF 2015 ORDER:
This criminal petition under Section 438 of the Code of Criminal Procedure is filed by the petitioner/accused seeking grant of anticipatory bail in crime No.41 of 2015 on the file of the Penugonda Police Station, Penugonda, West Godavari District, registered for the offences under Sections 467, 468, 419, 471, 506 IPC read with Section 34 IPC.
Heard and perused the material available on record. Learned counsel for the petitioner submits that the petitioner has not committed any offence and he is a law abiding citizen and he is ready and willing to cooperate with the investigating agency and as such, he prays this Court to grant anticipatory bail to the petitioner herein. Learned Public Prosecutor submits that after due investigation, it is found that the petitioner has not committed any offence and as such, the petitioner's name is deleted from the present crime.
Considering the submission of the learned Public Prosecutor that the petitioner's name is deleted from the crime, the application apprehending the arrest of the petitioner herein is not maintainable and as such, it is liable to be dismissed.
