THE HON'BLE SRI JUSTI CE SANJAY KUMAR WRI T PETI TI ON No.3362 of 2019 ORDER:
The grievance of the petitioners was that the Revenue Divisional Officer, Ibrahimpatnam Division, Ranga Reddy District, was not disposing of their application dated 10.05.2018 whereby they sought issuance of a certificate under Section 38-E of the Andhra Pradesh (Telangana Area) Tenancy and Agricultural Lands Act, 1950.
The Revenue Divisional Officer, Ibrahimpatnam Division, Ranga Reddy District, filed a counter affidavit wherein he admitted receipt of the aforestated application dated 10.05.2018 of the petitioners. He however stated that a notice was issued on 20.03.2019 asking the petitioners to produce certain documents and the matter was adjourned to 16.04.2019 for enquiry.
Be it noted that this writ petition was filed on 18.02.2019 and it appears that the Revenue Divisional Officer, Ibrahimpatnam Division, Ranga Reddy District, issued the above communication after institution of this writ petition. That being so, it is for the petitioners to respond to the notice issued by the Revenue Divisional Officer calling upon them to submit additional documents.
In the event the petitioners submit the documents as directed, the Revenue Divisional Officer, Ibrahimpatnam Division, Ranga Reddy District, shall conclude the enquiry and take appropriate action as deemed fit and in accordance with law on the petitioners' application dated 10.05.2018 expeditiously and in any event, not later than three months from the date of receipt of such documents.
The writ petition is accordingly disposed of. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
