THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.4156 OF 2016 ORDER:

This petition is filed by the petitioners-accused Nos.1, 2, 4 & 5 under Section 482 Cr.P.C. seeking to quash the proceedings against them in Crime No.175 of 2015 on the file of Gopalapatnam Police Station, Visakhapatnam District.

Heard and perused the material available on record. The offence alleged against the petitioners is punishable under Section 365 IPC. It is alleged that the petitioners hatched a plan to grab the land of the de facto complainant and obtained forged adangal by creating documents and incorporated the name of the father of the petitioners 1 and 2. The allegations levelled against the petitioners are serious in nature. The truth or otherwise of the above said allegations can be ascertained during enquiry. Therefore, this Court is not inclined to interfere with the investigation against the petitioners. If the petitioners are aggrieved over the final report, if any, filed by the police, after completion of investigation, they are at liberty to challenge the same. Accordingly, the Criminal Petition is dismissed. Consequently, miscellaneous petitions pending, if any, shall stand closed. ______________ RAJA ELANGO, J March 28, 2016.
