HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION (TR) NO.2215 OF 2017 ORDER:

When the matter is taken up for hearing, it has been contended by the counsel for the petitioner that initially the petitioners filed the case before the then Administrative Tribunal of Andhra Pradesh at Hyderabad and it was numbered as O.A.No.3402 of 2014. The counsel for the petitioner further contended that the Tribunal was pleased to grant interim orders on 21.05.2014 directing the respondents to pass orders on the representation of the petitioner within a period of four weeks, and in pursuance of the said orders, the respondents have considered the case of the petitioner and rejected vide proceedings dated 04.09.2014, and subsequently the said O.A is transferred to this Court and the same is being taken up as the present writ petition.

In view of the above submissions, this Court is of the considered view that since the case of the petitioner has been considered by the respondents and rejected vide proceedings dated 04.09.2014, the cause in the writ petition does not survive and it is always open for the petitioner to challenge the rejection order dated 04.09.2014 in accordance with law.

Accordingly, the writ petition is closed. No order as to costs. Pending miscellaneous petitions, if any, shall stand closed. ______________________________ ABHINAND KUMAR SHAVILI, J 13th December, 2019 v v
