This petition is filed seeking for grant of anticipatory bail to the petitioner, who is the accused, in Crime No.789 of 2017 on the file of the Station House Officer, Gajuwaka Police Station, Visakhapatnam City. The offences alleged are under Sections 307 and 506 of IPC.

Heard the counsel for the petitioner and the Public Prosecutor appearing for the respondent.

As per the case of the prosecution, there are disputes between the de facto complainant and this petitioner, with regard to the de facto complainant running a Kharkana in a residential locality.

The counsel for the petitioner submits that a suit was filed by the de facto complainant against the order of the Greater Visakhapatnam Municipal Corporation.

But, the Public Prosecutor submits that as regards investigation under Section 307 IPC, the CC TV Footage clearly shows that the petitioner attacked the de facto complainant. 6.

Hence, in view of the said submissions, this court opines that this is not a fit case for granting anticipatory bail to the petitioner.

With the above observations, the Criminal Petition is dismissed. However, the petitioner can file a petition seeking for regular bail by surrendering himself before the Sessions court. The Sessions court shall dispose of the bail application, if any filed, on merits, expeditiously, preferably on the same day, subject to the pressure of other work.

As a sequel, the miscellaneous applications, if any pending, shall stand closed.
