This Petition coming on for hearing,upon perusing the Memorandum of Grounds of Criminal Petition and upon hearing the arguments of ST|.M.SHREEDHAR DASARI, Advocate for the Petitioner and of the Additional Public Prosecutor for the State of Telangana on behalf of the Respondent No.1 and none appeared for R2.

Crl.Petition No.1294 ot 2023 THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.1294 OF 2023 ORDER:

This Criminal Petition is filed under Section 482 of the Code of Criminal Procedure, 1973 (for short 'Cr.P.C.J by the petitionerAccused No.7 seeking to quash the proceedings against him in S.C.No.487 of 2022 pending on the file of XVII Special Sessions Judge FTC for Atrocities against Women, Hyderabad. The offences alleged against him are under Sections 343, 328, 366, 376 (2), 323, 504, 506, 427 read with 34 of Indian Penal Code and Section 66 (E) of Information Technology Ac., 2012.

Heard learned counsel for the petitioner - Accused No.7 and learned Additional Public Prosecutor for the respondent - State. Perused the record.

Learned counsel for the petitioner confined his prayer to dispense with the personal appearance of petitioner - Accused No.7.

Considering the submission of learned counsel for the T I petitioner, the attendance of the petitioner - Accused No.7 is

\ Crl.Petition No,7294 of 2023 dispensed with in S.C.No.487 of 2022 pending on the flle of )0/II Special Sessions Judge FTC for Atrocities against Women, Hyderabad, when represented by his counsel on record. The attendance of the petitioner is dispensed with subject to filing an affidavit by the petitioner stating that in his absence the proceedings conducted by his counsel will not be disputed by him in any manner and shall not dispute his identity also, However, the petitioner shall appear before the learned Special Sessions Judge as and when his presence is required. In the event of failure of the petitioner to appear when the Court directs, this order dispensing his attendance shall stand cancelled.

Accordingly, the Criminal Petition is disposed of. Needless to say, in the event of the petitioner filing an application seeking discharge, in the event of charges being not framed, the concerned Court shall dispose it of on merits within a period of four (04) weeks from the date of filing after hearing arguments on both sides.
