THE HONOURABLE SMT JUSTICE K. SUJANA CRIMINAL PETITION No.1807 of 2025 ORDER:
Seeking the Court to enlarge the petitioners who are arrayed as accused Nos.1 and 2 in Crime No.246 of 2024 of EOW TEAMVII, CCS Police Station, Hyderabad. 2.
The brief facts of the case are de facto complainant lodged a complaint against the petitioners stating that the petitioners induced him to invest Rs.11,60,000/- in their firm, MBD Business Solutions, promising his investment would double quickly. Farooq, a senior citizen from a respectable family, arranged the funds from his sister-in-law, who had saved for her children's marriages. 3.
Heard Sri D. Mohan Rao, learned counsel appearing on behalf of the petitioners, and Sri Syed Yasar Mamoon, learned Additional Public Prosecutor appearing on behalf of the respondent-State.

Learned counsel for the petitioner submitted that the allegations leveled against the petitioners are vague and baseless stating they have not committed any offence and have been falsely
implicated by the police at the behest of the complainant and local political leaders. He further submitted that the petitioners have no connection to the case and highlight that the prosecution's story is a hoax and that the another accused has filed a petition before this Court, and this Court has ordered that accused Nos.2 to 6 should not be arrested. Therefore, prayed this Court to grant bail to the petitioners by allowing this criminal petition. 5.
On the other hand, learned Additional Public Prosecutor vehemently opposed the submissions made by learned counsel for petitioners, stating that the allegations leveled against the petitioners are serious in nature. At this stage, granting of prearrest bail to the petitioners does not arise. Therefore, he prayed the Court to dismiss the Criminal Petition.

Considering the rival submissions and reviewing the material available on record, it is noted that the petitioners face allegations under Sections 406 and 420 read with 34 of the IPC and Section 5 of the TSPDFE Act, 1999. The petitioners have been in jail since December 24, 2024. As the material part of the investigation is completed, this Court deems it fit to grant bail to the petitioners subject to the following conditions:
i.
The petitioners shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of the learned Sessions Judge, Hyderabad.
ii.
The petitioners shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.
iii.
The petitioners shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
