This petition is filed for a writ of Mandamus declaring the endorsement dated 15.11.2016 in Proc.No.9/2016, passed by the 3rd respondent under Section 71(2) of the Registration Act, 1908 refusing to register the sale deed presented by the petitioner in respect of the land admeasuring Ac.1.51 cents equivalent to 0.611 hectors of dry land in Sy.No.72/2 Kakupalli bit-1 Village, Nellore Rural Mandal, SPSR Nellore District, without assigning any reasons, as illegal and arbitrary.
Learned counsel for the petitioner submits that no reasons are assigned by the 3rd respondent for refusal of the document presented by the petitioner for registration. Heard the learned Assistant Government Pleader for Revenue.
perusal of the impugned endorsement dated 15.11.2016 goes to show that no reasons are assigned for refusal except stating that the document presented by the petitioner is refused for registration under sub-section 2 of Section 71 of the Act.
Since the impugned order lacks reasons, the same is set aside and the 3rd respondent is directed to pass orders afresh by giving reasons within a period of four (04) weeks from the date of receipt of copy of this order, if not already passed.
With the above direction, the writ petition is allowed to the extent indicated above. No costs.
