THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 13627 of 2011 ORDER:
The complaint of the petitioner in this case was that the Station House Officer, Pulivendula Urban Police Station, Pulivendula, Kadapa District, was calling him to the police station and compelling him to sign as a routine duty. He therefore sought a direction to the police not to interfere with his life and liberty except in accordance with law.
Basing on the written instructions dated 31.05.2011 received from the Station House Officer, Pulivendula Urban Police Station, Y.S.R Kadapa District, the learned Assistant Government Pleader for Home stated that the petitioner was involved in Crime Nos.42 of 2011, 54 of 2011, 47 of 2001 and 15 of 2005 in Kadapa and Anantapur Districts. He further stated that except for registering and investigating Crime No.42 of 2011 on the file of the Pulivendula Urban Police Station, Kadapa, he did not call the petitioner to the police station or interfere with his life and liberty. He further stated that in the said crime, the petitioner was bound over by the Mandal Executive Magistrate, Pulivendula, for good behaviour on 13.04.2011.
The aforestated facts demonstrate that the petitioner's allegation that there was undue interference with his life and liberty is without basis. In any event, if the police authorities have to summon or examine the petitioner in connection with any criminal offence, they are bound to follow the due procedure laid down by law. Reserving liberty to the police authorities to do so, the Writ Petition is closed. Pending Miscellaneous Petitions shall also stand closed. No order as to costs.
