Heard learned counsel for the petitioner, learned Government Pleader for Revenue and learned Government Pleader for Roads and Buildings.

With the consent of both the parties, the Writ Petition is disposed of at the admission stage.

The present Writ Petition came to be filed seeking Writ of Mandamus directing respondent Nos.3 to 5 not to demolish the house of the petitioner situated in land admeasuring Ac.0.05 cents in Survey No.323/ 1C, Elchuru Village, Santhamaguluru Mandal, Prakasam District, without notice and without following due process of law.

Though various grounds are raised, learned counsel for the petitioner restricts his prayer seeking a direction to the respondents not to demolish the house of the petitioner, without following due process of law.

Learned Government Pleaders submit that a representation was made by the petitioner which discloses passing of an award in favour of the husband of the petitioner and as such the question of forcibly dispossessing the petitioner or demolishing her house would not arise. It is submitted that any action done would be in accordance with law.

Having regard to the circumstances referred to above, the Writ Petition is disposed of directing respondent Nos.3 to 5 to follow the procedure established under law while dispossessing the petitioner or demolishing the house of the petitioner situated in a land admeasuring Ac.0.05 cents in Survey No.323/ 1C, Elchuru Village, Santhamaguluru Mandal, Prakasam District. 7.
