THE HON'BLE SRI JUSTI CE T.VI NOD KUMAR WRI T PETI TI ON No.3453 of 2020 ORDER:

This writ petition is filed to declare the action of respondents 5 and 6 in freezing the bank account of the first petitioner-firm maintained with Union Bank of India, Kandikal Gate Branch bearing A/c.No.327601010220048 (Current Account) and in preventing the second petitioner from peaceful running of business with respect to manufacturing, packing, sales and distribution of business products into the market, as illegal, arbitrary and in violation of Articles 19 and 21 of the Constitution of India.

Heard the learned counsel for the petitioners and the learned Assistant Government Pleader for Home for respondents 1 to 5. 3.

Learned Assistant Government Pleader for Home, on written instructions, dated 18.02.2020, a copy of which is placed on record, while denying the allegations made in the writ affidavit, submits that fifth and sixth respondent authorities did not freeze the bank account of the first petitioner-firm bearing A/c.No.327601010220048 maintained with Union Bank of India, Kandikal Gate Branch. By the said instructions, it is also denied that fifth and sixth respondent authorities are preventing the second petitioner from peaceful running of the business and further it is stated that fifth respondent never prevented the second petitioner from running the said business. Further, the learned Assistant Government Pleader submits that except investigating into three cases registered against the second petitioner on the complaints of the family members,

the respondent authorities never interfered in the business of the second petitioner.

Recording the above said submission made by the learned Assistant Government Pleader on behalf of official respondents, no further orders need be passed in the matter except permitting the respondent authorities to investigate into the cases registered against the second petitioner on the complaints made by the family members.

Subject to the above, the writ petition is disposed of. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
