THE HON'BLE DR. JUSTICE B.SIVA SANKARA RAO WRIT PETITION No.20945 OF 2017 ORDER:

This writ petition is filed, under Article 226 of the Constitution of India, for the following relief: "to issue a Writ, Order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in interfering with the petitioners lands in R.S.No.168-1B, 168-1A, 168-1F in an extent of Ac 1.00 cents each situated at Swarnavarigudem Village, Jeelugumilli Mandal, West Godavari District without acquiring the lands as per the provisions of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 & Rules, 2014, is illegal, arbitrary and violative of Article 14, 21 & 300-A of Constitution of India, consequently direct the respondents to initiate land acquisition proceedings as per the Act 2013 and to pass such other order or orders as this Hon'ble Court may deems fit and proper in the circumstances of the case."

Heard learned counsel for the petitioners and also the learned Government Pleader for Land Acquisition, representing the respondents and perused the prayer in the writ petition and also the written instructions received by the learned Government Pleader.

Undisputedly, there is no award passed in the matter, from the written instructions received by the learned Government Pleader.

Having regard to the above, this writ petition is disposed of, permitting the petitioner to make a representation, within one week from today with supporting documents of any entitlement to claim compensation for the land claimed in question and the respondents shall consider the same and pass appropriate orders, in accordance with law. 5.

Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence. No order as to costs.
