M.A. Salam v. Smt.Rehmatunnisa Begum
THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI C.C.C.A.No.238 of 1999 ORDER:
At the hearing, learned counsel for the appellants submitted that after this appeal is listed for hearing finally, he addressed registered letters to both the appellants to come and instruct him to proceed further in the Appeal and that the said letters remained undelivered for the reason 'left without instructions' and that acknowledgements or returned covers are not yet received, but the letters are undelivered when attempted to be delivered for the reason 'left without instructions' could be known from the tracking of the Postal Department's website and that he already filed a Memo, dated 15.02.2018, before the Registry stating the above facts. 2.
In view of the above said facts, this Court is of the view that the appellants are not interested in prosecuting the appeal. Further, since the learned counsel for the appellants has addressed registered letters to the appellants, in the considered view of this Court, there is no need to issue notices to the appellants.
3.
In the result, the Appeal Suit is dismissed for default. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order.
There shall be no order as to costs.
