The grievance of the petitioner, an Additional Public Prosecutor in the Court of the learned II Additional District and Sessions Judge
(FTC), Khammam, was that he was not paid his salary for the period November 2003 to February 2005.
The Director of Prosecutions, Hyderabad, filed a counteraffidavit stating that the petitioner was appointed as an Additional Public Prosecutor for the subject court under G.O.Rt.No.1467, Law (L.A.&J-Cts.A2) Department dated 20.09.2005 and due to nonavailability of budget, his remuneration could not be paid to him for the sixteen month period between November 2003 and February 2005. However, the Government issued orders finally in Memo dated 08.04.2005 to meet the said expenditure from the budget for the financial year 2005-2006. Thereupon, the Senior Assistant Public Prosecutor (Administration), Khammam, drew a sum of Rs.1,12,000/- through cheque No.783462 and paid the same to the petitioner in July, 2005 under proper acquittance. This payment was made for the period November 2003 to February 2005 at the rate of Rs.7,000/- per month. The Director further stated that no dues remained to be paid to the petitioner thereafter.
In the light of the afore-stated developments, the grievance of the petitioner as regards the non-payment of his salary stands redressed.
The writ petition is accordingly closed. Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs. ____________________ JUSTICE SANJAY KUMAR 13th August, 2015 IBL
