HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.2149 of 2016 ORDER:

This petition is filed by the petitioner under Section 482 Cr.P.C. seeking to quash the proceedings against him in FIR No.58 of 2016 on the file of the WPS Police Station DD., Hyderabad, registered for the offence punishable under Sections 498-A, 496 IPC r/w Sections 4 & 6 of the Dowry Prohibition Act.

Heard and perused the material available on record. Considering the facts and circumstances of the case and the nature of the proceedings, this Court is not inclined to grant the relief sought for in this petition.

At this stage, the learned Counsel for the petitioner has submitted that petitioner has given an undertaking before the investigating agency to the effect that he will not leave the Country without informing the same to the investigating agency, and in view of the said undertaking, the petitioner cannot leave the Country and therefore, the petitioner may be permitted to leave the Country for a period of six months.

In view of the above submission, the petitioner is permitted to leave the Country for a period of six months. He is directed to appear before the Court below concerned where the FIR is filed, on or before 7.9.2016.

Accordingly, the Criminal Petition is disposed of.

Consequently, miscellaneous petitions pending, if any, shall stand closed.
