THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.27399 of 2011 ORDER:

This writ petition was filed alleging police interference with the petitioner's rights over the land admeasuring Acs.4.45 cents in Survey No.597/4 of Savisetti Palli Village Fields, Sri Avadutha Kasinayana Mandal, Y.S.R. District.

The Sub-Inspector of Police, B.Mattam Police Station, Y.S.R.District, Kadapa, filed a counter-affidavit denying the allegation of the petitioner that the police authorities were instigated to interfere with the possession and enjoyment of the petitioner over the subject land by the 4th respondent. He stated that no complaint had been received or registered against the petitioner by B.Mattam Police Station, Y.S.R.District, and that the dispute between the petitioner and others was purely civil in nature. He therefore asserted that the police authorities had nothing to do with it and stated that they had never interfered with the possession and enjoyment of the petitioner over the subject property. He also stated that the police authorities had no power to dispossess the petitioner from the subject land and that the allegation to the contrary made by the petitioner that the police were interfering with his possession and enjoyment was factually incorrect. The stand of the police authorities as set out in the above counter is taken on record.

In the light thereof, the allegation of the petitioner that the police authorities are interfering with his possession and enjoyment over the subject land does not hold water.

The writ petition is accordingly closed.

Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
