HON'BLE SRI JUSTICE SURESH KUMAR KAIT AND HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.2934 of 2018 ORAL ORDER: (Per Suresh Kumar Kait, J) Vide the present petition, petitioner has assailed order dated 20.12.2017 passed by the Andhra Pradesh Administrative Tribunal at Hyderabad in O.A.No.2296 of 2017, whereby the application filed by the petitioner under Section 19 of the Administrative Tribunals Act, 1985, has been dismissed. The case of the petitioner is that while he was working as Fireman in Ongole Fire Station, he was transferred to Kondepi Fire Station by District Fire Officer, Prakasam District in Rc.No.412/A1/2017 dated 24.05.2017. In pursuance of the said order, petitioner was relieved on 25.05.2017 at 11.30 a.m., at Ongole Fire Station and joined at Kondepi Fire Station on the same day, i.e., 25.05.2017 at 13:30 hours.

It is pertinent to mention here that, two months after joining at Kondepi Fire Station, petitioner filed O.A., before the Tribunal questioning the transfer order dated 24.05.2017. It is the admitted case of the petitioner that he had completed 2 1⁄2 years of service at Ongole Fire Station, whereas the transfer policy is 3 years. The fact remains that petitioner joined at Kondepi Fire Station on 25.05.2017 after relieving himself from Ongole Fire Station on the same day. Thus, we find no ground to interfere with the order dated 24.05.2017 passed by the 4th respondent and order dated 20.12.2017 passed in O.A.No.2296 of 2017 by the learned Tribunal at this stage. Writ petition is accordingly dismissed. No order as to costs.
