THE HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.3448 OF 2019 ORDER:

The case of the petitioner is that it was issued notice on 16.02.2019, proposing to seize its premises, on the ground that it is using stilt parking in cellar in the residential flats for commercial purposes.

Though learned counsel for the petitioner, initially, submitted with respect to the illegality of the notice, he prays that if eight weeks' time is granted, he would find alternative accommodation and move out of the premises. In the facts of the present case, as the petitioner is a small-scale entrepreneur, carrying on the business of assembling of the electric items and as the same is likely to jeopardize the financial interests of the petitioner, it shall not be disturbed for a period of eight (08) weeks, subject to filing of an unconditional undertaking before the second respondent within three days.

With the above direction, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous petitions pending in the Writ Petition, if any, shall stand closed.

Learned Standing Counsel shall inform the second respondent the orders of this Court, as it is likely to take some time in providing the copy.
