ORDER

This writ petition is filed seeking to declare the action of respondents in trying to evict the petitioner from his lands to an extent of Ac.3.27 cents in Sy.Nos.478, 459 and 429 of Inumella Village, Epuru Mandal, Guntur District, without following due process of law, as illegal and arbitrary.

2. The allegation made in the writ petition is that the respondent authorities have visited the lands of the petitioner and are interfering with the agricultural operations. To prove the said allegation, learned counsel for the petitioner has filed a paper cutting reported in the newspaper showing that the revenue authorities had visited the lands of the petitioner.

3. Incidentally, the Tahsildar has been arrayed as 4th respondent and his name is also arrayed as 5th respondent in this writ petition.

4. Learned Assistant Government Pleader for Revenue submits that the petitioner had earlier filed W.P.No.2458 of 2015, which came to be withdrawn on 09.02.2015. In response to the allegation in W.P.No.2458 of 2014 and also in response to W.P.7025 of 2015, the 4th respondent has furnished written instructions. As per the said instructions, the land to an extent of Ac.1.77 cents in Sy.No.478 is ryotwari patta land and the lands to an extent of Ac.15.5 cents in Sy.No.459 and Ac.14.92 cents in Sy.No.429 are recorded as lands belonging to Devastanam (Bhajanthri Nowkary) and are inam lands. The instructions also denied with regard to the interference by the revenue officials with respect to the petitioner's lands in Sy.Nos.478, 459 and 429.

In that view of the matter, having considered the submissions of the learned counsel for the petitioner and having perused the instructions submitted by the 4th respondent that there is no interference by the revenue officials with respect to the petitioner's lands, no orders are required to be passed in the present writ petition. The prompt response by the 4th respondent is required to be appreciated in submitting the instructions to the learned Government Pleader for Revenue.

6. Accordingly, the Writ Petition is closed. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
