HON'BLE SRI JUSTICE S.V. BHATT W.P. No.13056 OF 2017 ORDER:
Heard Mr.K.Ravinder Reddy for petitioner and the learned Assistant Government Pleader (Revenue) for respondents. The petitioner aggrieved by the notice issued under Section 6 of the Land Encroachment Act, on 22.02.2017 filed appeal before the 3rd respondent. Mr.Ravinder Reddy, on instructions, submits that the appeal filed on 22.02.2017 is numbered, taken on file and the petitioner is regularly attending the hearings. The present writ petition has been filed seeking protection of petitioner's possession pending consideration and disposal of the appeal filed by petitioner before the 3rd respondent. The substantive prayer is pending consideration before the 3rd respondent. The counsel appearing for both the sides though have tried to convince this Court on a few issues on merits of the matter, since appeal is pending, the counsel have requested the Court to direct 3rd respondent to dispose of the appeal filed by petitioner on 22.02.2017 within reasonable time.
I have perused the Para-wise remarks given by respondent No.4.
The 3rd respondent is directed to dispose of the appeal within four months from the date of receipt of a copy of this order. To preserve the subject matter of appeal intact, while disposing of the writ petition, this Court considers it appropriate to direct both parties to maintain status quo as regards physical features of subject
matter of appeal till the appeal is heard and disposed of as stipulated by this Court.
The writ petition is disposed of accordingly. No order as to costs.
