folder subject to correction s if any This application is filed by the petitioner-accused No.2 to relax the condition stipulated under Section 438(2) (iii) i.e., the petitioner shall not leave India without the previous permission of the Court imposed by this Court in Crl.P.No.1511 of 2024 dated 12.02.2024.

Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor.

Learned counsel for the petitioner submitted that while granting anticipatory bail to the petitioner, this Court imposed condition that "the petitioner shall comply with the conditions stipulated in Section 438 (2) of Cr.P.C.". The petitioner was the Executive Chairman of a reputed pharmaceutical company and it was incumbent upon him to travel abroad for the purpose of undertaking the affairs of the company. He made all the travel arrangements for his travel to Srilanka on 24.02.2024, by way of chartered flight. Due to this condition, he was facing immense hardship and prayed to relax the above condition. Learned Additional Public Prosecutor submitted that if the petitioner would cooperate with the investigation, there would be no objection for them to relax the said condition. Considering the reasons stated by the learned counsel for the petitioner, it is considered fit to relax the condition stipulated under

2 Crl.P. No. 1511 of 2024 Section 438(2) (iii) i.e., "the petitioner shall not leave India without the previous permission of the Court" imposed by this Court in Crl.P.No.1511 of 2024 dated 12.02.2024. The other conditions hold good. The petitioner shall cooperate with the investigation and shall appear before the Investigating Officer as and when his presence is required.

In the result, the application is allowed relaxing the condition with the above direction.
