THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE P.KESHAVA RAO WRI T PETI TI ON No.2877 OF 2018 ORDER: (per Hon'ble Sri Justice Sanjay Kumar) Sri R.Siva Sai Swaroop, learned counsel for the petitioner, seeks leave to withdraw the writ petition reserving liberty to the petitioner to approach the Bank of India as and when a fresh One Time Settlement scheme is offered.
Smt.T.Vidya Rani, learned counsel on caveat for the Bank of India, states that the offer made by the petitioner under the existing One Time Settlement scheme has been rejected on 01.09.2017 and 06.11.2017. The writ petition is accordingly dismissed as withdrawn with the liberty aforestated. This order shall however not preclude the bank from initiating/pursuing the proceedings under the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002, if necessary.
Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
