O R D E R

This Criminal Petition is filed under Section 483 (1) of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') by the petitioner-accused to relax the condition imposed by the learned Special Court for SPE and ACB Cases-cum-III Additional District and Sessions Judge, Warangal, vide order, dated 30.06.2025, in Crl.M.P.No.77 of in Crime No.02/RCA-ACB-WRL/2025.

Heard Sri Thoom Srinivas, learned counsel for the petitioner/accused and Sri D.Arun Kumar, learned Additional Public Prosecutor appearing for the respondent-State.

The learned III Additional Sessions Judge at Warangal while granting bail to the petitioner-accused imposed a condition directing him to appear before the DSP, ACB, Warangal Police Station, on 2nd Monday of every month till filing of the charge sheet. Aggrieved by the same, the present criminal petition is filed.

The contention of learned counsel for the petitioner is that though one year has been elapsed from the date of registration of crime, no charge sheet is filed till date by the respondent officials; that as petitioner has been regularly appearing before the respondent officials no further appearance of petitioner is required and hence, he requested the Court to relax the condition imposed against the petitioner by the learned Sessions Judge.

On the other hand, learned Additional Public Prosecutor opposed the same on the ground that the Investigating is yet to be completed and statements of witnesses have to be recorded and hence he prays to dismiss the criminal petition.

Having regard to the submissions made by learned counsel on either side and taking into considerations the material available on record, since the petitioner has been

SKS,J Crl.P.No.1329 of 2026 appearing before Investigating Officer from 17.03.2025, further appearance of the petitioner before the respondent officials is not required. However, the petitioner-accused shall appear before the respondent officials as and when required by them. 7.

With the above observation, the Criminal Petition is disposed of.

Miscellaneous applications, if any pending, shall stand closed.
