Order:
At the interlocutory stage, the Civil Miscellaneous Appeal is taken up for hearing and disposal with the consent of the learned Counsel for the parties.
This Civil Miscellaneous Appeal is filed against Order, dated 07-03-2014, in IA.No.136 of
2014 in OS.No.29 of 2014, on the file of the Court of the learned XIV Additional District Judge, Vijayawada.
The respondent herein filed OS.No.29 of 2014 for perpetual injunction against the appellant. Pending the said suit, the respondent has filed IA.No.136 of 2014 for ad interim injunction. The appellant has contested the said application. After a detailed hearing of the case, the lower Court has allowed the said IA and granted interim injunction in favour of the respondent.
After hearing the learned Counsel for both the parties, I am of the opinion that as the injunction was granted as far back as 07.03.2014, it would be in the interests of justice, if the suit itself is disposed of at an early date. As the suit is filed for an injunction simplicitor, the lower Court is directed to dispose of the same within six months from the date of receipt of this order.
Subject to the above direction, the Civil Miscellaneous Appeal is disposed of.
As a sequel to disposal of the Civil Miscellaneous Appeal, CMAMP.No.604 of 2014, filed by the appellant for interim relief, is disposed of as infructuous.
