In all these writ petitions, petitioners are running Educational Institutions to impart Polytechnic Course of Study. Their grievance was in not fixing the tuition fee to be collected from the students in private un-aided Polytechnics as recommended by State Level Committee constituted by the Government vide G.O.Ms.No.625 dated 22.08.2013 and fixing the fee at lower leve1 i.e. Rs.15,500/- and adhering to the said fixation ignoring the recommendations of the State Level Committee. 3.

This Court, by way of interim order, directed the petitionersInstitutions to collect fee at Rs.21,000/- inclusive of special fee, based on the recommendations made by the State Level Committee. The fee as directed by the Court was collected and students were imparted the course of study.

According to the learned counsel representing the State Board of Technical Education and Training (SBTET) and Admission and Fee Regulatory Commission (AFRC) interim order initially sought was only for the academic year 2013-2014 whereas the College Managements went on collecting the fee for subsequent years also. He would further submit that as the academic year 2013-14 is already completed, the cause in the writ petitions does not survive.

At this stage, learned counsel for the petitioners Sri Pandu Ranga Reddy submits that AFRC is not determining the fee that can be collected by the private Educational Institutions, thereby causing hardship to the Educational Institutions and thus seeks a direction to AFRC/SBTET to determine the fee that can be collected from the students, who are admitted to Polytechnic Course. Since the cause in the writ petitions is with regard to the fee that can be collected from the students for the academic year 2013-2014, this Court is not inclined to go into this issue at this stage.

Leaving it open to the petitioners-Institutions to work out their remedies as available in law with reference to determination of fee that can be collected from the students who are admitted to the petitioners-Educational Institutions from the academic year 2019-2020, all the Writ Petitions are closed by making the interim order earlier passed by this Court as final order and with a further direction that the difference of amounts of fee collected from the students as compared to the fee determined by the Government need not be returned to the students.
