HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.3333 of 2015 ORDER:

Heard the learned counsel for the petitioner and learned Government Pleader for Transport appearing for respondents. Petitioner herein complains seizure of his vehicle the motor cab bearing No.AP-04-TT-8674 vide check report No.31 dated 29.01.2015. Petitioner questions the seizure on the ground that no enquiry was conducted and all the relevant documents relating to the said vehicle though produced were not looked into. The check report Ex.P1 shows that no records were produced before the third respondent at the time of check. Hence, the vehicle was seized. The request of the petitioner for release of the vehicle therefore has to be appropriately considered by the second respondent.

Hence, the writ petition is disposed of giving liberty to the petitioner to approach the second respondent by making an appropriate application seeking release of vehicle by producing all the necessary documents in support of his claim. After filing of such application and after receipt of the same by the second respondent from the petitioner, he shall examine and pass appropriate orders thereon. However, the orders may accordingly be passed within three days from the date of receipt of the application filed by the petitioner. No order as to costs. The miscellaneous petitions, if any, pending in this writ petition shall stand closed.
