THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY SECOND APPEAL No.1050 of 2004 JUDGMENT:

This appeal is filed under Section 100 CPC aggrieved by the judgment and decree dated 29.06.2004 in A.S.No.108 of 1997 on the file of the Court of VI Additional District & Sessions Judge (FTC), Krishna, Machilipatnam, whereby whereunder the learned Judge reversed the judgment and decree dated 12.08.1997 in O.S.No.258 of 1995 passed by the Subordinate Judge, Avanigadda.

At the time of hearing, learned counsel for the appellants seeks permission of this Court to permit the appellants to withdraw the second appeal and to that effect he also filed a letter dated 20.10.2017 before the Registry. Permission is granted.

Accordingly, the Second Appeal is dismissed as withdrawn. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
