HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.3488 of 2019 ORDER:

The prayer of the petitioner in this case reads as under: "For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus declaring the action of respondent No 3 in not mutating the petitioner name in B-1 ROR as pattadar and possessor of land to an extent of Ac.1.22 guntas in Sy No.83/A of Toopranpet Village, Choutuppal Mandal, Nalgonda District, and not issuing title deed and patta pass book in his name in respect of the above property in pursuance of his application dated 22.3.2017 for mutation vide on line application No.MU021701205315 dated 22.03.2017 receipt No T1 2662348 made to respondent No.

3 as illegal, arbitary, violative of Articles-14, 21 and 300A of Constitution of India and consequently direct respondent No.3 to mutate her name in B-1 ROR as pattadar and possessor of land to an extent of Ac.1.22 guntas in Sy No.83/A of Toopranpet Village, Choutuppal Mandal, Nalgonda District, and issue title deed and patta pass book in his name in respect of the above property in pursuance of his application dated 22.3.2017 for mutation vide on line application No.MU021701205315 dated 22.03.2017 receipt No T1 2662348 and to pass such other order or orders as this Honourable Court may deem fit and proper in the facts and circumstances of the case."

Perusal of the record reflects that the petitioner submitted an application in the prescribed format in Form VIA along with the document under which he claims title in relation to the subject land. This application was submitted online as long back as on 22.3.2017 and the endorsement thereon reads to the effect that action would be taken within 45 working days.

Having received such an application, it is not open to the Tahsildar, Choutuppal Mandal, Bhongir-Yadadri District, to remain inactive for such a long period of time.

The Writ Petition is accordingly disposed of directing the Tahsildar, Choutuppal Mandal, Bhongir-Yadadri District, to take

SK, J WP.No.3488 of 2019 Dt:20.02.2019 appropriate action upon the petitioner's application expeditiously and in any event, not later than four weeks from the date of receipt of a copy of this order.
