Koppineni Venkata Krishna v. The State Of Telangana
THE HONOURABLE SRI JUSTI CE SANJAY KUMAR WRI T PETI TI ON NO.3499 OF 2019
O R D E R
The prayer of the petitioner in this case reads as under: 'For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue an appropriate writ, order or direction more particularly one in the nature of Writ of Mandamus, directing the respondents not to entertain any sort of document and perform the Mutation for land admeasuring 1 Acre 20 Guntas in Sy No 122/& situated at Gongulur Village, Pulkal Maudal, Sangareddy District and consequently direct the respondents to consider the representation of the petitioner dated 31-12-2018 and to grant such other relief or reliefs as this Hon'ble Court deems fit and proper in the circumstance of the case.'
By way of the representation dated 31.12.2018, the petitioner requested the Tahsildar, Pulkal Mandal, Sangareddy District, not to carry out any mutation or change of title in relation to the subject land or issue any pattadar pass books or title deeds in connection therewith. However, the said representation also reflects that a registered sale transaction already took place in favour of some third party who has not been impleaded as a party respondent in this case and the petitioner filed a civil suit seeking cancellation of the registered sale deed. It is not open to the petitioner to cite the mere pendency of the said suit as a ground for interdicting the revenue authorities from taking action. It is for the petitioner to seek necessary relief in the pending suit. Leaving it open to the petitioner to do so, the writ petition is dismissed. Pending miscellaneous petitions shall also stand dismissed. No order as to costs.
