THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.2971 OF 2018 ORDER:

This writ petition is filed challenging the endorsement of the fourth respondent, dated 21.12.2017, holding that the land of the petitioner in Survey Nos.282/1 and 283/1 of an extent of Acs.0.30 cents situated at Thiruchanur Village, Tirupathi Rural Mandal, Chittoor District, is inam land.

It appears the said endorsement was passed pursuant to an order passed by this Court in W.P.No.2615 of 2017, dated 25.01.2017 and a contempt case is also filed by the petitioner. It is submitted by the learned counsel for the petitioner that when a notice was issued by the fourth respondent, the petitioner attended the Office along with the documents, but the Officer was not available and immediately thereafter, the impugned order was passed stating that the petitioner or his representative failed to produce ryotwari patta granted by Inams Deputy Tahsildar, and the sale documents.

Now the learned counsel for the petitioner submits that the petitioner possesses the required documents and he is ready to produce the same if an opportunity is given to the petitioner. In the circumstances, the impugned order passed by the fourth respondent, dated 21.12.2017, is set aside and liberty is given to the petitioner to approach the fourth respondent on 26.02.2018 along with the link documents and after considering the same, the fourth respondent shall pass appropriate orders in accordance with law within a period of two weeks thereafter.

The writ petition is accordingly allowed by setting aside the impugned order, dated 21.12.2017, passed by the fourth respondent. Consequently, miscellaneous petitions, if any pending, in this writ petition, shall stand closed.
