SMT JUSTICE T.RAJANI CRIMINAL PETITON No.1039 OF 2018 ORDER:

This petition is filed seeking for grant of anticipatory bail to the petitioner, who is one of the accused, in Crime No.185 of 2016 on the file of Paderu Police Station, Visakhapatnam. The offences alleged are under Sections 20(b)(ii)(c) r/w 8(c) of NDPS Act, 1985. 2.

Heard the counsel for the petitioner and the Public Prosecutor appearing for the respondent.

The role of this petitioner came to light, on the confession of the other accused. This petitioner is stated to be a Prohibition and Excise Inspector. The public prosecutor vehemently opposes the petition on the ground that this petitioner is involved in another crime and that in the said crime, the two petitions, moved for anticipatory bail by the petitioner, were dismissed. 4.

Hence, considering the above, this Court opines that this is not a fit case for granting anticipatory bail. 5.

Accordingly, the Criminal Petition is dismissed. However, the petitioner can file a petition seeking for regular bail by surrendering himself before the court below having the jurisdiction. The court below shall dispose of the bail application on merits, if any filed, expeditiously, preferably on the same day, subject to the pressure of other work.

As a sequel, miscellaneous petitions pending consideration, if any, in this case shall stand closed.
