THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.3451 OF 2019 O R D E R :

This writ petition is filed for a Writ of Mandamus declaring the action of the respondents in not considering the case of the petitioner for appointment to any suitable post in lieu of the acquirement of the patta land of the petitioner to an extent of 0.05 gts, in Sy.No.2/LU 1MD in Vazinepally Village, Mellachervu Mandal, Suryapet District for construction of Pulichinthala Project 4 x 30 Mega Watts, Hydro Electric Power System (Genco Power Plant) is highly illegal, arbitrary, and in violation of Articles 14, 16 and 21 of Constitution of India and sought for a consequential direction to respondents to consider the case of the petitioner for appointment to any suitable post as per his eligibility in Suryapet District. Heard Sri C.Raja Shekhar Reddy, learned counsel for the petitioner and learned Government Pleader for Services-II.

It has been contended by the petitioner that an extent of Ac.0.05 gts of land was acquired by the respondents from the petitioner during 2003 for construction of Pulichinthala Project and since petitioner's family is deprived of their livelihood, the Land Acquisition Officer recommended the case of the petitioner for appointment in lieu of the acquiring the land of the petitioner under the scheme of Rehabilitation to the Superintending Engineer. Learned counsel for the petitioner contends that petitioner had submitted a representation on 21.03.2018 to the District Collector who is the competent authority to give appointment under the Scheme of Rehabilitation and the same is pending before the District Collector.

Learned Government Pleader had submitted that the case of the petitioner would be considered and appropriate orders would be passed on the representation submitted by the petitioner in accordance with law.

This Court, having considered the rival submissions of both the parties, is of the considered view that this writ petition can be disposed of directing the District Collector to consider the representation submitted by the petitioner on 21.03.2018 and pass appropriate orders in accordance with law within a period of eight

(08) weeks from the date of receipt of copy of this order. Accordingly, Writ Petition is disposed of. There shall be no order as to costs.

Pending miscellaneous applications, if any, shall stand closed in consequence.
