THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE Dr. JUSTICE SHAMEEM AKTHER Writ Appeal No.998 of 1988 Judgment: (Per the Hon'ble The Acting Chief Justice Ramesh Ranganathan) This appeal, under Clause 15 of the Letters Patent, is preferred against the order passed by the learned Single Judge in W.P. No. 9797 of 1983 dated 25.1.1988.
Sri V.V. Prabhakara Rao, learned counsel for the respondentwrit petitioner, submits that the respondent-writ petitioner died and his son has not contacted them despite their repeated efforts. Learned Government Pleader appearing on behalf of the Advocate General for the State of Telangana, would submit that it would suffice if the question of law, decided in the order under appeal, is left open to be adjudicated in appropriate legal proceedings, and the writ appeal is closed.
Leaving the question of law laid down in the order under appeal open for examination in appropriate legal proceedings, the order under appeal, to the limited extent certain Clauses in the Andhra Pradesh Detailed Standard Specifications was held unconstitutional, is set aside.
The writ appeal stands disposed of accordingly.
Miscellaneous Petitions pending, if any, shall also stand disposed of. There shall be no order as to costs.
