HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN Writ Petition No.497 of 2013 ORDER:

The relief sought for in this Writ Petition is to declare the seizure, and continued detention of the petitioner's vehicle, by the 3rd respondent as arbitrary and illegal.

By way of an interim order in W.P.M.P.No.610 of 2013 dated 04.01.2013, this Court directed release of the vehicle on condition that the petitioner paid Rs.10,000/-. This Court made it clear that it was open to the respondents to issue notices demanding tax, if any; and that the petitioner was under an obligation to produce the photostat copies of the documents, together with the originals, for comparison. The petitioner was also directed to file an undertaking not to alienate the vehicle, and to produce it as and when it was required. Sri Rajanikanth Jwala, Learned Counsel for the petitioner, would submit that the petitioner has complied with the interim order dated 04.01.2013 and, in addition to depositing Rs.10,000/-, they have also filed a letter of undertaking.

If that be so, the respondents may issue notices to the petitioner for payment of the tax due under Section 8 of the A.P. Motor Vehicles Taxation Act, and take action for any other violations on their part after giving them an opportunity of being heard. On such notices being issued, it is open to the petitioner to put forth their objections thereto.

With these observations, the Writ Petition is closed. The miscellaneous petitions pending, if any, shall also stand closed. There shall be no order as to costs.
